Terms of Engagement
1. Service provider
Build Support Services operates under ABN 37 117 598 679.
2. Nature of the service
Build Support Services provides practical building advice under an agreed written scope. Unless expressly stated, the service is not building or trade work; structural engineering; building surveying, certification or permit approval; quantity surveying; legal, financial or insurance advice; destructive testing; emergency response; a formal pre-purchase inspection; or an expert report for litigation or a tribunal.
3. Forming an engagement
Submitting an enquiry does not create an adviser-client relationship or confirmed booking. An engagement begins when Build Support Services confirms the scope, fee and timing in writing, the client accepts those terms and any required payment is received.
4. Scope
Advice is limited to the agreed service and the information available at the time. Additional questions, documents, site visits, reports or ongoing support may require a revised scope and additional fee.
5. Client responsibilities
The client must provide accurate, complete and timely information; identify relevant deadlines and known risks; provide safe and lawful site access; obtain required permits, approvals and specialist advice; use appropriately licensed or qualified practitioners; and make the final decisions concerning the property and project.
6. Reliance and limitations
Advice may rely on documents, photographs, descriptions and other information supplied by the client or third parties. Unless expressly agreed, Build Support Services does not verify third-party information or carry out invasive inspection or testing. Some issues may be concealed and cannot be identified without opening up work, testing or specialist assessment. Advice is specific to the client, property and agreed purpose and must not be relied upon for another project without written approval.
7. Project roles and responsibilities
Build Support Services may help clarify, plan and coordinate the next steps. Builders, trades, designers, engineers, surveyors and other specialists remain responsible for their own work, permits, construction, safety and certification.
8. Fees and payment
Fees are stated on the Fees page or in a written quotation. Payment is required before the consultation or work begins unless otherwise agreed. Additional work is not undertaken without approval. Travel, testing, third-party services and disbursements are charged only where stated or approved.
9. Cancellation and rescheduling
More than 48 hours notice allows a full refund or one reschedule. Between 24 and 48 hours notice may incur a 50% cancellation charge. Less than 24 hours notice or non-attendance may incur a 100% charge. If Build Support Services cancels, the client may choose a full refund or reschedule. These terms operate subject to the Australian Consumer Law and exceptional circumstances accepted by Build Support Services.
10. Referrals and conflicts
Where specialist or trade input may be useful, Build Support Services may identify a type of provider or, where requested, suggest a provider. Any known related-party interest, commercial arrangement or potential conflict will be disclosed. The client remains responsible for deciding whether to engage a third party and for reviewing that party’s qualifications, insurance, terms and work. Build Support Services does not guarantee third-party work.
11. Confidentiality and privacy
Client information is handled in accordance with the Privacy Policy. Project records may be retained where reasonably required for service delivery, legal obligations, insurance and business administration.
12. Intellectual property
Build Support Services retains ownership of its templates, methods, diagrams and original materials. The client may use deliverables prepared specifically for the engagement for the agreed property, project and purpose. They may not be published, resold or used for another project without written consent.
13. Liability and consumer rights
To the extent permitted by law, the liability of Build Support Services for any claim arising out of an engagement is limited to the resupply of the advisory services or the payment of the cost of having those services supplied again. Nothing in these terms excludes, restricts or modifies a right or guarantee that cannot lawfully be excluded under the Australian Consumer Law.
14. Ending the engagement
Either party may end an ongoing engagement by written notice. The client remains responsible for fees and approved costs incurred up to the termination date. Build Support Services may suspend or end an engagement where material information is withheld, payment is overdue, site conditions are unsafe, the requested action would be unlawful or the professional relationship has materially broken down.
15. Governing law
These terms are governed by the laws of Victoria, Australia. The parties submit to the courts and tribunals having jurisdiction in Victoria.
